Text se zabývá trestností šíření nakažlivé nemoci z ústavního hlediska. Poukazuje na ústavní problém, kdy je na ústavní úrovni požadováno, aby trestnost činu stanovil zákon. Ovšem seznam nakažlivých nemocí je vydán pouhým podzákonným předpisem – nařízení vlády.

The text deals with the criminality of the spread of a contagious disease from a constitutional point of view. He points to a constitutional problem where the constitutionality of a crime is required by law at the constitutional level. However, the list of contagious diseases is issued by a mere by-law a government decree.
